ALABAMA REGULATIONS WITH REGARDS WRONGFUL DEATH CASES 

The rules and regulations regarding wrongful death actions in Alabama differ from those in other states. In Alabama a wrongful death action must be brought by a personal representative, which is the administrator or executor of the estate of the person who passed. A wrongful death claim is brought pursuant to Alabama Code § 6-5-410. If you recently experienced an unexpected wrongful death please contact one of the attorneys at The Kelly Law Firm, P.C., as soon as possible. In Alabama, the statute of limitations for filing a wrongful death claim is two years from the time of the death of the loved one.  


DAMAGES AWARDED

The Alabama wrongful death statute only allows awarding punitive damages (damages exceeding simple compensation to punish the defendant).  Alabama is unique in that aspect, because most states award compensatory damages as well.
