In the State of Alabama, there are several ways to end a marriage including no-fault (no wrongdoing by any party), or fault based (one party filed a complaint against the other party) grounds.
No-Fault based divorces are the most common divorces filed in Alabama. However, it is very hard to prove the wrongdoing of the other party. The only two grounds that are considered are incompatibility and irretrievable breakdown of the marriage.
Fault-Based grounds include: adultery, one party was incapacitated at marriage, voluntary abandonment from bed and board, one party is imprisoned in a penitentiary, commitment of a crime against nature, addiction to drugs or habitual drunkenness, complete incompatibility of temperament, one party is confined in a mental hospital for a period of five years, irretrievable breakdown of marriage, the wife was pregnant at the time of marriage without his knowledge or agency, actual violence on his or her person, and when the wife has lived separate and apart from bed an board of the husband of two years without support from the husband.
